Sweepsouth Placements & Subscriptions Terms & Conditions
These Terms and Conditions govern the use of Sweepsouth’s Placement Services and Subscription Services. By proceeding with a placement application, paying any applicable fee, or activating a Subscription, the Client agrees to be bound by these Terms.
1. Definitions
“Client” means the individual or household engaging a Candidate through Sweepsouth.
“Candidate” means any cleaner, nanny (Mom’s Helper), or carer introduced through Sweepsouth.
“Placement” means the introduction and matching of a Candidate to a Client.
“Private Placement” means engagement of a Candidate off the Sweepsouth platform following payment of a Placement Fee.
“Subscription” means the ongoing on-platform engagement model where the Client pays a recurring monthly fee to retain a Candidate through Sweepsouth at a self-determined rate.
“Subscription Bookings” means recurring bookings created under the Subscription product structure.
2. Nature of Services
Sweepsouth provides two distinct engagement models following a successful match:
2.1 Private Placement (Off-Platform)
Upon payment of the Placement Fee, the Client will engage the Candidate independently outside of the Sweepsouth platform.
In this model:
- Sweepsouth exits operational involvement.
- All payment, scheduling, compliance, and employment obligations transfer to the Client.
2.2 Subscription – Managing your forever Sweepstar with Sweepsouth
Under Subscription:
- The Candidate remains active on the Sweepsouth platform.
- An employment relationship is created between Client and Candidate.
- The Client sets a recurring daily rate (subject to minimums defined by Sweepsouth).
- 100% of the agreed rate is paid to the Candidate.
- Sweepsouth charges a separate recurring monthly Subscription fee of R99 to manage the payments, payouts, and system admin of the platform technology.
Subscription Bookings are a distinct product category separate from standard one-time or recurring bookings.
3. Independent Contractor Status
All Candidates remain independent contractors of Sweepsouth unless engaged under a Private Placement.
Under Subscription:
- An employment relationship is created between Client and Candidate.
- The Candidate remains free to accept other work outside of their agreed upon contract with the Client.
Under Private Placement:
- An employment relationship is created between Client and Candidate.
- Sweepsouth does not act as employer, co-employer, or labour broker.
4. Screening & Matching
Sweepsouth conducts reasonable screening including:
- Identity verification
- Right to work checks
- Reference checks
- Criminal background checks
- Skills assessment (where applicable)
Sweepsouth does not guarantee accuracy or completeness of information provided by Candidates.
Final hiring decisions remain the Client’s responsibility.
5. Fees
5.1 Initiation Fee
A non-refundable administrative fee of R399 is payable to begin the placement process and cover the vetting process of candidates to the Client’s application.
5.2 Placement Fee (Private Placement Only)
If the Client elects to engage the Candidate off-platform:
- R1 249 (incl. VAT) – Housekeeper
- R2 249 (incl. VAT) – Nanny
- R2 249 (incl. VAT) – Elder Carer
Payment of the Placement Fee constitutes formal release of the Candidate from the Sweepsouth platform for purposes of the Client engagement.
5.3 Subscription Fee
Under Subscription:
- The Client pays R99 per month.
- The fee recurs automatically until cancelled.
- Subscription may be cancelled by written request to Support.
If Subscription is cancelled:
- All upcoming Subscription Bookings will automatically cancel.
6. Subscription rate rules
Clients may set their own daily rate for Subscription Bookings.
However:
- The minimum daily rate is:
- R300 for Housekeeping (Indoor Cleaning)
- R400 for Nanny (Mom’s Helper)
- Sweepsouth reserves the right to update minimum rates at any time.
- Rates may not be set below the applicable minimum.
Sweepsouth does not deduct any percentage or commission from Subscription Booking payments.
All Subscription Booking earnings are paid 100% to the Candidate via standard weekly payout processes.
7. Backup & Replacements (Subscription Only)
7.1 Temporary Absence
If a Candidate cancels an individual Subscription Booking:
- Sweepsouth will make reasonable efforts to provide a backup Candidate unless otherwise stated by the Client.
- Backup services are subject to availability.
- Backup bookings may be charged at standard once-off platform rates.
7.2 Permanent Departure
If a Candidate permanently leaves the Sweepsouth platform due to:
- Retirement
- Illness
- Voluntary departure
- Termination
And the Client originally sourced the Candidate through Placements and activated Subscription:
Sweepsouth will provide one replacement round at no additional Placement Fee, provided:
- Subscription remains active
- All Subscription fees are up to date
8. Employment Compliance (UIF, COIDA & Labour Law Obligations)
8.1 Full Transfer of Employer Responsibility
Upon confirmation of a Private Placement and payment of the Placement Fee:
- The Client becomes the sole legal employer of the Candidate
- All statutory, tax, and labour law obligations transfer immediately to the Client
- Sweepsouth ceases all responsibility for compliance, administration, or oversight
This includes, but is not limited to:
- Registration as an employer
- Monthly payroll administration
- Statutory contributions
- Record keeping
- Legal compliance with applicable labour legislation
8.2 Mandatory UIF Registration
The Client must:
- Register as an employer with the Unemployment Insurance Fund (UIF)
- Obtain a valid UIF reference number
- Register the Candidate as an employee under their profile
- Submit monthly declarations and contributions
Important Acknowledgements
The Client acknowledges that:
- UIF registration is a legal requirement, not optional
- Failure to register or contribute may result in:
- Financial penalties
- Interest on arrears
- Legal enforcement by the Department of Labour
- Historical non-compliance (including prior domestic workers) may:
- Delay onboarding of a new employee
- Require settlement of outstanding balances before compliance is restored
8.3 COIDA Registration (Compensation for Occupational Injuries and Diseases Act)
Where applicable, the Client is responsible for:
- Registering as an employer with the Compensation Fund (COIDA)
- Submitting required documentation
- Paying annual assessment fees
- Maintaining compliance for workplace injury cover
Important Acknowledgements
The Client acknowledges that:
- COIDA registration timelines are not controlled by Sweepsouth
- Processing delays by authorities are common
- Failure to register may expose the Client to:
- Personal liability for workplace injuries
- Legal and financial risk
8.4 No Advisory or Intermediary Role
Sweepsouth:
- Does not provide UIF or COIDA registration services
- Does not act as an intermediary with government departments
- Does not submit declarations or payments on behalf of the Client
- Does not verify or audit Client compliance
Any guidance provided by Sweepsouth:
- Is general informational guidance only
- Does not constitute legal, tax, or compliance advice
8.5 Third-Party Service Providers
Sweepsouth may, at its discretion:
- Refer Clients to third-party service providers for UIF or COIDA assistance
However:
- Sweepsouth is not responsible for:
- The services provided
- Costs charged
- Outcomes or delays
- Any engagement with such providers is solely between the Client and the provider
8.6 Ongoing Monthly Obligations
The Client is responsible for ensuring that:
- Monthly UIF declarations are submitted accurately and on time
- Contributions are paid in full each month
- Records of payments and submissions are retained
The Client acknowledges that:
- Late or missed submissions may result in:
- Penalties (including percentage-based penalties on arrears)
- Accrued interest
- Escalating financial liability over time
8.7 Payroll, Payslips & Record Keeping
The Client is solely responsible for:
- Paying the Candidate directly (if not on Subscription)
- Maintaining accurate payroll records
- Issuing payslips (recommended best practice)
- Keeping proof of payment
Sweepsouth:
- Does not process salaries
- Does not generate payslips
- Does not store employment records
8.8 Employment Contracts
The Client is responsible for:
- Drafting and maintaining a compliant employment contract
- Ensuring alignment with applicable labour laws (e.g. Sectoral Determination 7)
Sweepsouth:
- May provide general templates or guidance
- Does not guarantee legal compliance of any document
8.9 Indemnity for Non-Compliance
The Client agrees to indemnify and hold Sweepsouth harmless from:
- Any claims, penalties, or legal action arising from:
- Failure to register for UIF or COIDA
- Failure to make required contributions
- Misclassification of employment
- Breach of labour laws
8.10 Explicit Client Acknowledgement (CRITICAL CLAUSE)
By proceeding with a Private Placement, the Client explicitly confirms that they:
- Understand they are the legal employer
- Accept full responsibility for UIF and COIDA compliance
- Accept all risks associated with non-compliance
- Will not hold Sweepsouth responsible for:
- Registration failures
- Missed contributions
- Government system issues
- Penalties or legal consequences
9. Liability
Sweepsouth acts solely as a platform and introduction service Candidate.
To the fullest extent permitted by law:
- Sweepsouth disclaims liability for loss, injury, damage, or theft arising from the actions or omissions of any Candidate including any failure by Sweepsouth to disclose information about a candidate, as a result of the candidate’s non-disclosure of such information to Sweepsouth
- Sweepsouth does not supervise day-to-day services.
- Sweepsouth does not guarantee continuous availability of any Candidate.
Where applicable, Sweepsouth may maintain platform-level insurance coverage. The existence of such coverage does not extend liability beyond policy limits nor create any employment relationship.
10. Non-circumvention
A Client may not directly engage a Candidate introduced by Sweepsouth outside the platform within 12 months of introduction unless the applicable Placement Fee has been paid.
If a Client engages a Candidate privately without payment of the Placement Fee, Sweepsouth reserves the right to:
- Charge the applicable Placement Fee, and/or
- Suspend access to platform services.
- Deactivate the Candidate for soliciting in Private work outside of their agreement with Sweepsouth.
11. Cancellation of Subscription
Subscription may be cancelled at any time by written notice to Support.
Cancellation will result in:
- Termination of the recurring R99 fee
- Automatic cancellation of all future Subscription Bookings
Cancellation does not entitle the Client to refund of fees already billed for the current month.
12. 90-Day Replacement Guarantee (Placements)
For Private Placements only:
Sweepsouth offers one replacement round within 90 days of the Candidate’s start date, subject to:
- Written request within 7 days of departure
- Confirmation of last working day
- One replacement round consisting of up to 5 interviews
Initiation Fees and Placement Fees remain non-refundable.
13. Indemnity
The Client agrees to indemnify and hold harmless Sweepsouth, its directors, employees, and agents from any claims arising from:
- Off-platform employment relationships
- Failure to comply with labour or tax laws
- Disputes with Candidates
14. Acceptance
By submitting an application, paying any applicable fee, or activating a Subscription, the Client confirms acceptance of these Terms and Conditions.
